Obligations of the waste carrier and broker placed outside Finland
A waster carrier from outside of Finland is entitled to register as a waste carrier in Finland. An operator from a country in the European Economic Area presents the registration made in their home country to a Finnish authority who enters the company into the Finnish waste management register on the basis of the principles of mutual recognition.
In the transport of certain wastes, the law requires the use of a transfer document and the submission of the information in the transfer document to the SIIRTO register: Transfer document – report the information to the SIIRTO register.
Countries of the European Economic Area, mutual recognition
A notification of the entry in the register and an extract from the register are sent to the operator. A copy of the extract from the register must be carried when transporting waste, and it must be presented when required to the customs authorities, the police or the authority supervising the transport of waste.
The entry concerning mutual recognition is made for a fixed period if the registration in the other European Economic Area country has been made for a fixed period.
The information provided is verified every three years. The authority will send a request for verification to the operator. If the operations are changed earlier, the operator must notify the Southeast Finland Centre for Economic Development, Transport and the Environment of the changes without delay.

Other countries
Waste carriers from outside the European Economic Area apply for registration in Finland once certain conditions have been met.
The operator is sent a decision on registration and an extract from the register. A copy of the extract from the register must be carried when transporting waste, and it must be presented when required to the customs authorities, the police or the authority supervising the transport of waste.
The decision on registration is valid until further notice or for a fixed period.

Waste brokers in Finland
A waste broker buys or sells waste professionally or acts as an intermediary for waste or waste management services on behalf of others. Waste brokers also include brokers who do not physically take possession of the waste.
A waste broker’s domicile must be in a country belonging to the European Economic Area.
Foreign waste brokers operating in Finland must apply for registration in Finland. The broker is given a decision on registration if the applicant fulfils the required conditions.
The operator is sent a decision on registration and an extract from the register. If required, the extract from the register must be presented to the supervisory authority.
The decision on registration is valid until further notice or for a fixed period.

International shipments of waste
A waste broker must be aware of the notifications and permits required for international shipments of waste. The Finnish Environment Institute is the competent authority for the notifications and permits for international shipments of waste.
Legislation
Collection, transport and brokerage of waste within Finland
The collection, transport and brokerage of waste require approval from the authorities. In the transport of certain wastes, the law requires the use of a transfer document and the submission of the information in the transfer document to the SIIRTO register.

Obligations of the waste holder in the transport of waste
Under the law, the waste holder is usually the producer of the waste. However, the waste holder may also be another party in the waste transport. Control of waste before transport is essential.
The holder may also be, for example, a main contractor, waste broker or waste collector.
A household is not considered to be a waste holder.

Check the information and permits of the carrier and transferee of the waste
Before ordering the transport of waste, the waste holder must check that:
- the waste carrier has been approved and entered in the waste management register and that the approval covers the transport of the waste in question.
- the waste transferee is approved by the authority for the reception of the waste in question, e.g. an environmental permit.

Prepare transfer documents and report the data to the SIIRTO register
The waste holder is obliged to draw up a transfer document for the types of waste listed below.
The transfer document must be drawn up for the transport of the following types of waste:
- Construction and demolition waste, except contaminated soil
- Hazardous waste
- Septic tank and cesspool sludge
- Sludge from sand and grease interceptors
- Contaminated soil
- Persistent organic pollutants (POP)
The details of the transfer documents must be entered in the SIIRTO register after the end of the transfer.

Obligations of the waste carrier and broker
The waste carrier is responsible for the transport of the waste. Waste broker refers to an entity that professionally purchases, sells or brokers waste or waste management services on behalf of another party.

Submit a waste management register application
If you transport waste or act as a waste broker, the operations must be approved in the waste management register. The driver is obliged to keep an extract from the waste management register available during the transport of waste.

Acknowledge and carry the transfer document during transport
When a transport company accepts waste requiring a transfer document, the driver is obliged to acknowledge the transfer document. The driver must also ensure that the transfer document is carried during transport and that the parties involved in the transfer have access to the transfer document.

Prepare a transfer document for household waste
The carrier is obliged to draw up a transfer document for certain types of waste from households. In this case, the carrier also has other obligations concerning the waste holder’s transfer documents, such as the obligation to report the data to the SIIRTO register.

Obligations of the waste collector
Professional waste collection refers to the collection of waste at reception points arranged by municipalities, producer organisations, distributors or other waste management service companies. Professional waste collection is typically a collection point.

Report collection operations to the authority
A professional waste collector must submit a notification of the collection operations. The notification is submitted to the environmental protection authority of the municipality in whose territory the collection is carried out.
The authority enters the information in the waste management register.

Manage the transfer document obligation
If the collector receives, transfers or forwards waste requiring a transfer document, the collector is obliged to submit a transfer document. Depending on the situation, the collector is subject to the legal obligations of the waste holder, the carrier or the transferee.

Obligations of the transferee
In waste transports, transferee refers to the party in whose possession the waste ends up. The transferee of the waste may be, for example, a waste handler, a waste station or a waste centre, a waste broker or a waste collector.

Environmental permit or other official approval for the receipt and handling of waste
Other official approvals may include registration in accordance with the MARA Decree (867/2017).
